Employment-Based Immigration – EB-1
If you have an extraordinary ability in the sciences, arts, education, business, or athletics with national or international recognition, are an outstanding professor or researcher or are a multinational executive, you can apply for the EB-1 visa.
Your claim to either of these categories must be demonstrated by professional acclaim, but you do not need an offer of employment to apply. If you wish to apply in the area of academia, you must have a minimum of three years as a teacher or researcher in a particular field and must have been internationally recognized for your achievements. Whatever route you choose, your extraordinary ability must be proven.
Employment-Based Immigration – EB-2
The EB-2 visa is similar to the EB-1 in that it allows visas to those who have documented exceptional abilities. For those in the academic arena, you must have an advanced degree and a minimum of five years of relevant experience in your field of study.
The requirements are also similar to those of the EB-1. You may be able to circumvent some of the qualifications with a national interest waiver. The immigration experts at XYZ would clarify whether or not you are eligible and how to apply for it if you are.
Employment-Based Immigration – EB-3
This visa is granted to those eligible aliens who are skilled, unskilled or professional workers. Skilled laborers are those with a least two years of work experience or training towards permanent employment.
Professionals have a minimum of a bachelor’s degree (or its international equivalent) and is a member of a profession pertinent to his or her degree. Other qualified workers include unskilled laborers and those with less than two years of experience or training.
H1-B Visas for Temporary Workers
Employers needing employees in a specialty occupation may bring in foreign workers if there are not enough US citizens to fill those positions with an H1-B. The sponsoring employer has to have a relationship with the employee prior to applying for this visa.
This visa also extends to certain researchers, those engaged in development projects sponsored by the US Dept. of Defense, and renowned fashion models. Each has specified criteria which must be satisfied in order to apply.
