In order to qualify, the couple must plan to marry within 90 days of the fiancé(e)’s arrival. The marriage must be conducted with the intent of building a life together and not for the purpose of obtaining a green card.
If the couple marries within the required 90-day timeframe, the fiancé(e) may apply for lawful permanent residence in the United States.
Many relationships nowadays begin online and move forward with the parties only having communicated by phone and online platforms like Skype. Virtual and telephonic interaction alone though is insufficient for the approval of an application.
The couple must have seen each other at least once within the two years prior to submitting the application. If you cannot prove this, the application will be denied. Such in-person interaction is a requirement of the K-1 visa.
